Welcome to FairShare. These Terms of Service ("Terms") govern your use of the FairShare application and website (the "Service") operated by FairShare ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 13 years old and agree to comply with these Terms. If you do not agree, you may not use the Service.
2. Description of Service
FairShare is an expense-splitting application that helps groups of people track shared expenses and calculate optimized settlements. The Service:
- Allows users to create groups, add expenses, and track balances
- Calculates simplified settlement plans to minimize transactions
- Supports multiple currencies with automatic conversion
- Provides push notifications for group activity
FairShare is not a financial institution. We do not process payments, transfer money, or hold funds on your behalf. All actual payments between group members are made outside of the Service.
3. User Accounts
You are responsible for:
- Maintaining the security of your account credentials
- All activity that occurs under your account
- Providing accurate and up-to-date information
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Create false or misleading expense records to defraud other users
- Attempt to access other users' accounts or data without authorization
- Interfere with or disrupt the Service or its infrastructure
- Reverse engineer, decompile, or disassemble any part of the Service
- Use automated systems (bots, scrapers) to access the Service
- Upload malicious code or content
5. User Content
You retain ownership of the expense data and content you create in the Service. By using the Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service to you and your group members.
6. Pricing
FairShare is currently free to use. We reserve the right to introduce paid features in the future, but any existing free features at the time of change will remain free. We will notify users in advance of any pricing changes.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that:
- The Service will be uninterrupted or error-free
- Expense calculations or currency conversions will be perfectly accurate
- The Service will meet all of your requirements
8. Limitation of Liability
To the maximum extent permitted by law, FairShare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service.
FairShare is not responsible for any disputes between group members regarding expenses or payments. The Service is a tracking tool only, and actual financial settlements are the sole responsibility of the users involved.
9. Indemnification
You agree to indemnify and hold harmless FairShare and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Account Termination
You may delete your account at any time through the app settings. Upon deletion:
- Your personal information will be deleted within 30 days
- Your expense records in shared groups will be anonymized
- This action is irreversible
We may also terminate or suspend your account if you violate these Terms, with or without notice.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
